Last November, a provision was quietly slipped into a federal spending bill to reopen the government that included very restrictive language around hemp-derived THC. The good news: Congress is now actively working on a bipartisan fix to create a three-year regulatory runway, rather than triggering sudden restrictions.
Before we get into details, here’s the most important thing to know: Nothing has been banned.
Hemp-derived THC products remain legal today — and nothing would change until November 2026.
No products have been pulled. No new rules are currently in effect. The provision in question wasn’t debated as a standalone hemp policy. It was added to a must-pass funding bill, which is why lawmakers, farmers, and industry leaders are now pushing to correct it before it could ever take effect. A bipartisan bill introduced this January would delay any potential restrictions until November 2028, giving regulators time to create clear, safety-focused rules instead of an abrupt, overbroad outcome.

As written, however, this provision could unintentionally impact many responsibly made full-spectrum hemp products — not just what most people think of as “THC.”

What this means for our products
Some full-spectrum hemp formulas — including certain CBD oils and topicals — could be impacted if the original language were ever allowed to take effect.
That said, roughly half of what we offer contains zero THC and would not be affected at all, including many products featuring CBN, CBG, THCV, CBDV, CBC, and CBD.
